DBCP Litigation - The firm has filed a major lawsuit against three chemical companies (Shell, Dow and Amvac) and Dole Food Company, for exporting and using DBCP on plantations in the Ivory Coast (West Africa) after it was banned in the United States, causing hundreds of plantation workers to become sterile. The lawsuit claims that these companies violated international law by committing crimes against humanity and "chemical genocide."

Marin v. Brush Wellman - In this class action the firm represents all current and former employees of Boeing who have tested positive for beryllium sensitivity. The case seeks to require Brush Wellman to provide medical monitoring for the sensitized workers to detect and treat the onset of Chronic Beryllium Disease, a horrible lung disease caused by exposure to beryllium.

Agent Orange Litigation - The firm is representing several hundred Vietnam Veterans who have developed hematologic diseases of the lymphatic system (non-Hodgkin's lymphoma, Hodgkin's disease, multiple myeloma, and chronic lymphocytic leukemia) against the manufacturers of Agent Orange.

Update: Dow v. Stephenson, Metzger Law Group has filed a brief in the U.S. Supreme Court on behalf of the Lymphoma Foundation of America and renowned scientists in support of veterans suffering from lymphoma and multiple myeloma from Agent Orange.

CERT v. McDonald's and Burger King, In this case, the firm is representing the Council for Education and Research on Toxics in a lawsuit against McDonald's and Burger King to require these companies to give cancer hazard warnings for their french fries, which contain very high levels of acrylamide, an industrial carcinogen. The California Attorney General has recently joined this case, so the Metzger Law Group will prosecute this case with the Attorney General on behalf of all Californians.

Update July 20, 2004: Metzger Law Group sent the letter to the Governor "Arnold Schwarzenegger" to explain the necessity and importance to the health of Californians of anticipated regulatory action by the Office of Environmental Health Hazard Assessment of the California Environmental Protection Agency concerning acrylamide in high-temperature fried potato products.


Update: Cal-EPA states that the "naturally occuring chemical" defense does not apply to Acrylamide in cooked food. Their statement also limits application of the so-called "cooking defense." This is a major blow to McDonald's and Burger King.


On September 3, 2002, Metzger Law Group filed suit on behalf of the Council for Education and Research on Toxics ("CERT") against McDonald's and Burger King, to enjoin McDonald's and Burger King from selling French fries without first providing a warning that the French fries contain acrylamide, a substance known to cause cancer in humans.
